SLN Swadista Affiliate Program Terms of Service

Agreement

By signing up to be an Affiliate in the SLN Swadista Affiliate Program (“Program”), you agree to be bound by the following terms and conditions (“Terms of Service”). SLN Swadista reserves the right to update these Terms of Service at any time, with changes notified to you via email or the affiliate dashboard. Continued participation in the Program after such changes constitutes your consent to the updated terms.

Violation of these terms may result in termination of your affiliate account and forfeiture of any unpaid commissions earned during the violation. You agree to participate in the Program at your own risk.

Account Terms

• You must be 18 years or older to participate in this Program.
• You must be a resident of India or a legally registered entity in India to be an affiliate.
• Accounts must be registered by individuals or entities, not automated systems or “bots.”
• You must provide your legal full name, a valid email address, a valid phone number, and any other information requested during signup.
• Each account is for use by one person or entity only. Sharing login credentials with others is not permitted.
• You are responsible for maintaining the security of your account and password. SLN Swadista is not liable for any loss or damage due to your failure to secure your account.
• You are responsible for all content posted and activity under your account.
• You may not maintain more than one affiliate account without prior written approval from SLN Swadista.
• You may not use the Program for any illegal or unauthorized purpose, including violating Indian laws such as the Information Technology Act, 2000, or copyright laws.
• You may not use your affiliate links or codes to purchase SLN Swadista products for personal use, as this may result in commission forfeiture or account termination.

Affiliate Links, Coupons, and QR Codes

• Upon joining the Program, you will be assigned a unique Affiliate Code for use in referral links, coupons, or QR codes.
• You may place affiliate links, banners, or graphics provided by SLN Swadista on your website, social media, emails, or other communications. You may also generate QR codes for your referral links using the Kaya QR Code Generator tool provided on our website.
• For online sales, use “Special Links” (links with your Affiliate Code) to ensure accurate tracking. For offline sales (e.g., exhibitions, direct selling, or distribution channels), you may share unique coupon codes or QR codes assigned to you.
• SLN Swadista will provide guidelines for link styles, graphics, and QR code usage. We may update these materials at any time, with notice for significant changes (e.g., image dimensions).
• Ensure all links, coupons, and QR codes are correctly formatted to track sales. SLN Swadista is not liable for commissions lost due to improper use of links, coupons, or QR codes.
• Affiliate links, coupons, and QR codes should direct customers to the relevant product or store page on https://slnswadista.com.

Referral Fees/Commissions and Payment

• You will earn a commission for each eligible product sale made through your Special Links, coupon codes, or QR codes, as tracked by WP Affiliate Manager.
• A sale is eligible if:
  • The customer clicks a Special Link, scans a QR code, or uses your coupon code to visit https://slnswadista.com and completes a purchase.
  • The sale is tracked automatically by our system or manually verified for offline sales (e.g., via coupons).
• Commissions are not paid for sales not tracked by our system, including cases where customers claim to have used your code without evidence.
• SLN Swadista reserves the right to disqualify commissions earned through fraudulent, illegal, or unethical marketing methods.
• Payments begin once your affiliate earnings exceed ₹1,500 (Indian Rupees). If your account doesn’t reach this threshold, commissions will roll over to the next payment cycle.
• Payments will be made monthly via bank transfer, UPI, or other methods agreed upon, within 30 days of crossing the ₹1,500 threshold.
• You are responsible for providing accurate payment details and complying with applicable tax laws, including GST if required.

Identifying Yourself as a SLN Swadista Affiliate

• You may not issue press releases or public statements about your participation in the Program without prior written approval from SLN Swadista.
• You may not misrepresent your relationship with SLN Swadista, claim to develop our products, or imply you are an employee or partner of SLN Swadista.
• You may identify yourself as an “SLN Swadista Affiliate” in promotional materials, provided you follow our guidelines and avoid misleading claims.

Customer Definition

• Customers who purchase through the Program are SLN Swadista customers. Our rules, policies, and procedures for orders, customer service, and sales apply to these customers.
• SLN Swadista may change pricing, product availability, or policies at any time without notice. Avoid displaying product prices on your site, as they may change.

Your Responsibilities You are solely responsible for:

• Operating and maintaining your website, social media, or other promotional channels.
• Ensuring your promotional materials (links, coupons, QR codes) comply with agreements you have with third parties (e.g., hosting providers, social media platforms).
• The accuracy and legality of content on your channels, including product descriptions and affiliate links.
• Ensuring your content does not infringe on copyrights, trademarks, or other rights.
• Complying with data protection laws, including the Digital Personal Data Protection Act, 2023, by disclosing how you collect, use, and store visitor data (e.g., through a privacy policy).
• Ensuring your marketing practices are ethical and comply with the Consumer Protection Act, 2019, avoiding misleading advertisements or claims.

Compliance with Indian Laws

• You must comply with all applicable Indian laws, including but not limited to:
  • Information Technology Act, 2000 (for digital transactions and data security).
  • Consumer Protection Act, 2019 (for e-commerce and advertising).
  • Digital Personal Data Protection Act, 2023 (for handling customer data).
  • Goods and Services Tax (GST) laws, if applicable to your earnings.
• You must comply with regulations governing email marketing, ensuring consent for promotional emails and providing opt-out options.

Term of the Agreement

• This Agreement begins when SLN Swadista approves your Program application and ends when either party terminates it.
• You or SLN Swadista may terminate this Agreement at any time with written notice (via email or the affiliate dashboard).
• Upon termination, you must immediately stop using and remove all SLN Swadista links, coupons, QR codes, trademarks, and logos from your channels.
• SLN Swadista may end the Program at any time, paying any outstanding commissions above ₹1,500 within 30 days of termination.

Termination

• SLN Swadista may suspend or terminate your account for violating these terms, engaging in fraudulent or unethical practices, or any other reason at our discretion.
• Termination will result in loss of access to your affiliate account and forfeiture of unpaid commissions if earned through prohibited methods.

Relationship of Parties

• You and SLN Swadista are independent contractors. This Agreement does not create a partnership, joint venture, agency, or employment relationship.
• You have no authority to make offers or representations on behalf of SLN Swadista.

Limitations of Liability

• SLN Swadista is not liable for indirect, special, or consequential damages (e.g., loss of profits or data) arising from this Agreement or the Program.
• Our total liability under this Agreement will not exceed the referral fees paid or payable to you.

Disclaimers

• SLN Swadista makes no warranties about the Program or products, including their fitness, merchantability, or availability.
• We do not guarantee that https://slnswadista.com will be error-free or uninterrupted, and we are not liable for any issues arising from such interruptions.

Dispute Resolution

• Any disputes related to this Agreement will first be addressed through good-faith negotiation between you and SLN Swadista.
• If unresolved, disputes will be referred to mediation in [Your City, State, India], under the Arbitration and Conciliation Act, 1996.
• If mediation fails, disputes will be resolved in the courts of [Your City, State, India], and you consent to their jurisdiction.

Governing Law

• This Agreement is governed by the laws of India, without regard to conflict of law principles.
• Any legal action arising from this Agreement will be filed in the courts of [Your City, State, India].

Miscellaneous

• You may not assign this Agreement without our prior written consent.
• SLN Swadista’s failure to enforce any provision of this Agreement does not waive our right to enforce it later.
• This Agreement is the entire agreement between you and SLN Swadista, superseding any prior agreements.
